1. Agreement to Terms

By accessing or using Shov ("the Service"), operated by MMOD, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Shov is a live streaming platform that allows users to broadcast and view live video content. The Service includes all features, tools, and functionality made available through our website and applications.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion.

5. User Content

You retain ownership of content you create and broadcast through the Service. By streaming or uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for the content you broadcast. You agree not to stream content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.

6. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) impersonate any person or entity; (c) interfere with or disrupt the Service; (d) attempt to gain unauthorized access to any part of the Service; (e) use automated means to access the Service without our permission; (f) harass, bully, or intimidate other users; (g) stream content that infringes on intellectual property rights of others.

7. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by MMOD, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. DMCA and Copyright

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please send a notice to hi@shov.com with the information required under the Digital Millennium Copyright Act.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL MMOD, INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless MMOD, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
